SUCCESSION OF
MISSY LYNN SULLIVAN
NO. 25956 DIV. "C"
FILED:
21ST JUDICIAL DISTRICT COURT
PARISH OF ST. HELENA
STATE OF LOUISIANA
DY. CLERK:
PETITION FOR AUTHORITY TO SELL MOTOR VEHICLE
The petition of James Sullivan, the duly appointed, qualified
and acting Administrator
herein, a person the full age of majority domiciled in the Par-
ish of St. Helena, State of Louisiana,
who files this Petition for Authority to Sell Motor Vehicle and
who respectfully represents the
following to wit:
1.
Petitioner avers that this Succession is solvent and that any
and all debts and liabilities of
the decedent have been satisfied and/or provided for.
11.
Notwithstanding the solvency of this succession, it is nec-
essary to liquidate assets of the succession to raise cash to pay
taxes, debts and expenses of administration. Additionally,
Petitioner notes that it would not be practical to render a
Judgment of Possession recognizing the heirs of the Decedent
as owners, and sending them into possession, of the Movable(s)
which is/are the subject of this Petition in light of the fact that
Petitioner, the surviving spouse of the Decedent,
is likely to be recognized as the owner of an undivided one-
half (1/2) interest in and to all of the
Succession's assets and a usufruct of the other one-half (1/2)
of the succession's assets together with the naked ownership of
an undivided one-half (1/2), over which Petitioner is likely to
enjoy
a usufruct, devolving to the Decedent's adult children.
111.
At the time of her death the Decedent owned a community
interest in both a 2024 Jeep Wrangler and a 2022 Open Range
Pull Behind (or tongue tow) camper. Upon information and
belief, the value of Decedent's interest in each of the above
referenced movables is well below the
liability resulting from the retail installment agreements
which are secured by the movables in question.
Petitioner deems it desirable and in the best interest of the
succession to sell, transfer, or otherwise convey the motor vehi-
cle(s) described above for the purposes of absolving the Succes-
sion of any and all liability associated with the subject movables
such that the Succession will have no liability upon the transfer
of same.
WHEREFORE PETITIONER PRAYS that the Court enter an
order authorizing
petitioner to sell the property described above for a price and
sum which is equivalent to, or greater than, the Succession's out-
standing liability on the retail installment contracts secured by
said movables and for any and all other relief which this Court
deems right and jus: on the premise.
Respectfully submitted,
